1. Definitions
The terms below shall have the meanings given to them in this article when they are used with a capital letter in these TOS.
“Site” refers to the website accessible at the address www.communications-impact.com
“Company” refers to the SA IMPACT registered to the Registre du commerce et des sociétés under number 978 915 718 R.C.S. Dijon office located at 6, rue Camille Claudel, Dijon, France.
“TOS” refer to these terms of service.
“User” refers to any person who uses the Site.
“Partners” refer to third-party companies whose products or services may be featured on the Site.
02. Presentation
The TOS are provided by the Company.
Its VAT identification number is FR 95978915718.
The TOS aim to explain the terms of access and use of the Site.
The publication director of the Site is Tiana Rasoahaingo.
The Site is hosted by HOSTINGER for the Company.
Any User of the Site must read and accept the TOS, as they apply to any use of the Site. In any case, any use of the Site is governed by these TOS.
These TOS may be modified at any time and at the discretion of the Company.
Users are invited to regularly consult the website to be informed of any modifications.
03. Purpose of the TOS
These TOS aim to define the conditions and modalities under which Users can access and use the Site. Anyone accessing the Site undertakes to read and respect these TOS, without reservation during their use. The Company is free to modify, at any time and without notice, these TOS, in particular to take into account any legal, jurisprudential, editorial, and/or technical developments. The prevailing version is the one accessible online. The applicable TOS are those in force on the date of connection and use by the Users.
04. Description of the Site
The Company offers on the Site a presentation of the services it may offer to its clients as well as the achievements it has been able to carry out on behalf of its clients.
The Site is therefore intended to be a showcase for the Company.
The Company does not claim to offer an exhaustive presentation of its products and services. It reserves the right to modify the Site or to offer different services to its clients without the need to present them on the Site.
The Site is exclusively intended for individual users acting in a professional capacity on behalf and for the account of a legal entity.
05. Accessibility of the Site
The Company endeavors to allow access to the Site 24 hours a day, 7 days a week, except in cases of force majeure as defined by Article 1218 of the Civil Code and applicable jurisprudence, or events beyond its control, and subject to any breakdowns and maintenance interventions necessary for the proper functioning of the Site.
Furthermore, Users acknowledge and accept that the accessibility of the Site also depends on the Internet network, which the Company does not control.
The Company cannot guarantee the availability of the Site and/or services, the reliability of transmissions, and performance in terms of response time or quality. No technical assistance is provided to the User, whether by electronic, telephone, or physical means.
The Company shall not be liable in the event of impossibility of access to the Site.
Furthermore, the Company may be required to interrupt the Site or part of the services at any time, without notice and without entitlement to compensation. The User acknowledges and accepts that the Company cannot be held responsible for interruptions, as well as the consequences that may result for the User or any third party.
Access to the Site is free of charge, subject to any possible charges for communications due to mobile phone operators and Internet service providers.
06. Suspension or Removal of Site Access
The Company may decide to suspend or remove any access to the Site at its sole discretion, especially in the event of a User’s non-compliance with these TOS.
This suspension or removal will be made without compensation or notice, and without the possibility for the User to claim any damages.
07. User Obligations
Users undertake to use the Site in accordance with the conditions of these TOS and, where applicable, those concerning the devices used to access this Site.
In general, Users undertake not to disrupt the proper functioning of the Site by any means and under any pretext. They also undertake not to use the Site in a manner contrary to any applicable legislation. Users also undertake not to harm the Site in any way, including partially or fully copying the Site and its files as well as associated data, or engaging in reverse engineering operations. They also undertake any other activity that could impact the image and reputation of the Company as well as its products and services, including the Site.
In this regard, subject to the possibility that the Company may allow Users to post content, Users undertake not to publish content that is defamatory, discriminatory, offensive, obscene, pornographic, or violent, and more generally, content that could infringe upon the rights of third parties or be harmful to third parties in any way and in any form.
The Company’s liability cannot be incurred in any case for these various reasons.
08. User Warranty and Liability
Users acknowledge and accept that they are solely responsible for their use of the Site at all times and in all places, and for the consequences that such use may entail.
Furthermore, Users acknowledge and accept that they assume full responsibility for any publication of content (including visual, textual, and audio) as soon as it is possible on the Site.
Moreover, Users guarantee the Company against any action brought by third parties or other Users alleging a violation of their rights.
09. Limitation of Company Liability
Users use the Site at their own risk. The Company cannot be held responsible in this regard.
Furthermore, the Company is not obliged to verify the identity of Users who access the Site, to monitor the activities of Users, or to moderate, if necessary, the content published by Users.
Moreover, Users are informed that the Company only presents the products and services it may offer. This presentation is non-binding. Thus, the Company declines all responsibility regarding the presentation of products and services as well as the content broadcast on the Site in a more general manner.
For all intents and purposes, it is reminded that the Company does not sell any products or services on the Site.
The Company cannot be held responsible for information about products and services published on its Site provided by Partners (images, descriptions, characteristics, etc.), especially if they differ from those present on a Partner’s website.

The Company owns all intellectual property rights relating to the Site as well as rights over the databases.
This includes in particular the trademark and logo of the Company, as well as the architecture of the Site.
Any reproduction or use of these elements without prior authorization from the Company constitutes an act of infringement which may be pursued as such and incur civil and criminal liability on the part of the author.
Notwithstanding the foregoing, the Company grants Users a simple license to use these rights for the sole purpose of accessing and using the Site. This license is worldwide and will terminate in the event of suspension or deletion of a User account or cessation of use of the Site.
In the event that Users are required to publish any content on the Site, they grant the Company, free of charge, a license to use and reproduce said content worldwide, on any medium, for any purpose and for the legal duration of protection of the intellectual property rights concerned.
12. Third-Party Links
The Company may publish hyperlinks to third-party websites.
In no event shall the Company be liable for the information and content provided on third-party websites referenced by these hyperlinks.
13. Applicable Law and Competent Jurisdiction
These TOS are drafted and interpreted in accordance with French law.
In the event of a dispute, the parties are invited to use a consumer mediator.
If this mediation fails, the rules of common law will apply between the Company and the Users to determine the competent jurisdiction.
